Court Action

  1. Jewell Anderson has been given an opportunity, on multiple occasions, to present her views regarding guardianship and conservatorship issues involving herself to both Judge Barry Grant and to Judge David Szymanski.  Both Judge Grant and Judge Szymanski have personally spoken with Jewell Anderson regarding her concerns with respect to the guardianship and conservatorship matters, and have taken Jewell Anderson’s opinions into consideration when making rulings relating to these matters.
  2. Jewell Anderson’s property has been protected for her benefit by the conservators/guardians appointed for Jewell Anderson, and Diane Anderson’s misappropriation of Jewell Anderson’s funds has been terminated.
  3. The Probate Court Judges assigned to this case have been open, fair, and impartial to all the parties involving the conservatorship and guardianship of Jewell Anderson.
  4. Actions of David Anderson, Martha Anderson, and Timothy Flynn have been reviewed repeatedly by the Probate Court Judges assigned to Jewell Anderson’s guardianship and conservatorship matters, and their actions regarding Jewell Anderson’s guardianship and conservatorship have been found to be totally appropriate and in conformance with all probate rules of law and procedure.
  5. Judge David Szymanski has found Diane Anderson to have been untruthful to the Probate Court on multiple occasions and, at two (2) separate Court hearings, Judge Szymanski came close to putting Diane Anderson in jail for contempt of court.  Judge Szymanski has determined Diane Anderson abused the Probate Court system by filing frivolous, vexatious, and harassing pleadings, and has sanctioned Diane Anderson for her abuse of the Probate Court system in an amount over $2,000.00.
  6. Judge David Szymanski found Diane Anderson in contempt of Court in December, 2008 and ordered her to serve jail time for her disrespect of the Court process and not following the instructions of the Court regarding being quiet when the Court was issuing its rulings in Jewell Anderson’s guardianship and conservatorship matters.
  7. Diane Anderson has been a negligent caregiver involving Jewell Anderson, having caused Jewell Anderson physical harm, and which negligence has resulted in medical treatment and/or hospitalization, while Jewell Anderson has stayed with Diane Anderson, and this issue has been a major concern to the Probate Court Judges.
  8. Jewell Anderson had an opportunity to live with her oldest son, Bruce Anderson, in the central Michigan area between October, 2005 through February, 2007, and she enjoyed her stay there greatly.  Jewell Anderson is now living in a beautiful apartment at the American House complex in Rochester Hills, Michigan, which is what Jewell Anderson requested in the late summer of 2003.
