Physical Abuse

DAVID ANDERSON, MARTHA ANDERSON, AND TIMOTHY FLYNN HAVE NOT ENGAGED IN PHYSICAL ABUSE OF JEWELL ANDERSON:

A.   Diane Anderson has Allowed Jewell Anderson to Suffer Physical Injury on Multiple Occasions.

At no point in time have David Anderson, Martha Anderson, or Timothy Flynn ever engaged in physical abuse as it relates to Jewell Anderson.  Between the Fall of 2003 through September of 2004, while Diane Anderson was supposedly taking care of Jewell Anderson, she allowed Jewell Anderson to become physically injured on multiple occasions.  During the Fall of 2003, Diane Anderson failed to monitor Jewell Anderson’s whereabouts, and Jewell Anderson walked out of her Lathrup Village home, unattended, and was injured while walking down the inclined driveway.  When this event occurred, Diane Anderson was in the basement using Jewell Anderson’s computer, blogging with her labor comrades in Australia, while Jewell Anderson lay physically injured and unattended in her driveway.

On at least two (2) different occasions, Diane Anderson allowed Jewell Anderson’s cat to bite her, causing significant lacerations to Jewell Anderson’s legs.  During the second biting of Jewell Anderson by her cat, Jewell Anderson had a serious infection of her wound, which Diane Anderson allowed to go untreated and resulted in a need for medical intervention and significant doses of antibiotics.

Again while Diane Anderson was down in the basement using Jewell Anderson’s computer, she allowed Jewell Anderson to take a bath, unattended, and when Jewell Anderson attempted to exit the bathtub, Jewell Anderson lost her balance and fell between the bathtub and the toilet commode, and was wedged in this area for a two (2) hour period, while Diane Anderson ignored her pleas for help.  When questioned regarding how she could have allowed these injury events to occur while being with Jewell Anderson twenty-four (24) hours a day, seven (7) days a week, Diane Anderson simply shrugged her shoulders and said, “Old people get hurt.”

Within several months of the first bathroom accident involving Jewell Anderson, Diane Anderson again left Jewell Anderson unattended in the bathroom at the Lathrup Village home, and Jewell Anderson had a second fall in the bathroom.  On this occasion, Jewell Anderson violently struck her arm on a towel holder with sharp edges and sustained a large gash on her arm which required both hospitalization and multiple stitches.  When the second bathroom accident occurred, Diane Anderson was again on Jewell Anderson’s computer in the basement of the home, neglecting her caregiving responsibilities to Jewell Anderson.  Diane Anderson’s callous disregard for the physical well being of Jewell Anderson was another factor which caused the children of Jewell Anderson to seek Probate Court intervention in the Fall of 2004.

B.   Diane Anderson has caused Psychological Injury to Jewell Anderson by Alienating Her from Immediate Family Members.

In October of 2005, Jewell Anderson’s oldest son, Bruce Anderson, was scheduled to have Jewell Anderson stay at his home in Vestaburg, Michigan.  Prior to this visit, Diane Anderson’s mental health problems got the better of her, and she left the Lathrup Village home with Jewell Anderson without letting any of the family members or Timothy Flynn, the public administrator for Jewell Anderson, know where she had taken Jewell Anderson for over a week.  When Jewell Anderson was finally returned to her Lathrup Village home by Diane Anderson, Timothy Flynn had no other choice but to change the caregiver arrangement from Diane Anderson to Bruce Anderson to protect Jewell Anderson from further physical and psychological injury by Diane Anderson.  During the period of time Jewell Anderson stayed with Bruce Anderson and his wife, Arliene Anderson, both highly respected, retired educators, Jewell Anderson enjoyed her stay in Vestaburg immensely.  Jewell Anderson’s physical health and psychological health were properly taken care of in every conceivable way by Bruce and Arliene Anderson.  Most significantly, Bruce and Arliene Anderson had Jewell Anderson participate in strengthening exercises and walking exercises, which made Jewell Anderson’s frail physical condition much stronger and better.

C.   Diane Anderson has Tried to Make Jewell Anderson Dependent Upon Her.

When Jewell Anderson was living exclusively with Diane Anderson, Diane Anderson attempted to make Jewell Anderson physically and psychologically dependent upon her.  Diane Anderson would never allow Jewell Anderson to participate in exercise programs, but instead, would unnecessarily push her around in a wheelchair, which all medical authorities felt was not in Jewell Anderson’s best interest.  Furthermore, Diane Anderson had Jewell Anderson use an oxygen tank when both Jewell Anderson’s doctors and Jewell felt the use of the oxygen tank was not necessary.  Diane Anderson caused additional expense to Jewell Anderson’s estate by needlessly renting oxygen tanks when Jewell Anderson’s doctors said it was unnecessary and not needed.

D.   Diane Anderson Caused Numerous Scenes at Unannounced Visits at Bruce Anderson’s Home.

No one excluded Diane Anderson or any of Jewell Anderson’s friends from visiting her at Bruce and Arliene Anderson’s home.  None of Jewell Anderson’s friends wished to take advantage of seeing Jewell Anderson while she was staying with Bruce and Arliene Anderson.  Diane Anderson came to Bruce and Arliene Anderson’s home on several occasions, without letting them know in advance she was coming.  When she did arrive at the Vestaburg home, she made a scene and caused Jewell Anderson to become visibly upset.  On several occasions when Diane Anderson appeared unexpectedly at the Vestaburg home, she made a scene with the police and disparaged them and the Vestaburg community.  On one occasion, Diane Anderson came to the home of Bruce and Arliene Anderson and unlawfully broke into and entered the home while Bruce and Arliene Anderson and Jewell Anderson were out running errands.  In the spirit of being a good brother, Bruce Anderson did not press criminal charges against Diane Anderson on the occasion she unlawfully broke and entered into his home.  Bruce Anderson, along with the other Anderson family members, recognized Diane Anderson has untreated mental health issues, which probably resulted in her committing the home invasion act.

E.   Death of Bruce Anderson Caused by Diane Anderson’s Constant Harassment.

In February of 2007, Bruce Anderson passed away.  Bruce’s family doctor believes his death was caused in part by the stress placed upon him by the constant harassment he received from Diane Anderson.  After Bruce Anderson passed away in February of 2007, Timothy Flynn determined the best interest of Jewell Anderson would be to have her reside at one of the American House facilities.  Timothy Flynn placed Jewell Anderson in a beautiful apartment at the prestigious Rochester Hills American House facility.  The apartment found for Jewell Anderson at the Rochester Hills American House facility has all the amenities anyone could possibly want, and completely meets Jewell Anderson’s residential needs.

F.  Jewell Anderson’s Desire to Live at the American House Facility in Rochester Hills, Michigan is Finally Fulfilled.

In the late summer of 2003, Jewell Anderson indicated to David Anderson that she wished to simplify her life, and that her Lathrup Village home was too much for her to take care of.  Jewell Anderson wanted to have Thanksgiving and Christmas in 2003 at the Lathrup Village home, and then move to the American House facility in Rochester Hills in January of 2004.  When this situation was explained by Jewell Anderson to Diane Anderson, Diane Anderson had an irrational outburst and refused to discuss this matter with Jewell Anderson and her children.  Instead of discussing Jewell Anderson’s decision to move from Lathrup Village to Rochester Hills in an adult-like manner, Diane Anderson ran upstairs and locked herself in a bedroom.  Subsequently, Diane Anderson told Jewell Anderson that if the Lathrup Village home was ever sold, she was going to move back to Australia and renounce her American Citizenship.  These statements were made by Diane Anderson with the sole purpose of causing psychological grief to Jewell Anderson.

G.  Interference by Diane Anderson with Jewell Anderson’s Doctors.

Diane Anderson has claimed, since coming back from Australia, to know more about Jewell Anderson’s physical and psychological condition than Jewell Anderson’s treating doctors.  When Jewell Anderson had various hospital stays between 2005 through 2008, Diane Anderson constantly interfered with the William Beaumont Hospital doctors’ and medical staff’s ability to provide treatment to Jewell Anderson.  Diane Anderson’s behavior became so bad during one of Jewell Anderson’s hospital stays that the legal staff at the hospital was contacted regarding her bad behavior toward the medical staff, and Diane Anderson came very close to being completely excluded from visitation with Jewell Anderson at the hospital.  On other occasions, Diane Anderson has berated the hospital staff at William Beaumont Hospital, and interfered with their attempts to provide proper medical care to Jewell Anderson.  All of these episodes have been recorded in the hospital records at William Beaumont Hospital involving Jewell Anderson.  These issues have also been brought to the attention of Timothy Flynn, guardian and conservator for Jewell Anderson, who has had to repeatedly admonished Diane Anderson from engaging in this behavior, to the detriment of Mr. Flynn’s ward.  Regrettably, due to her untreated mental health issues, Diane Anderson cannot understand that her interfering actions are causing serious problems for Jewell Anderson.  Fortunately, when these issues have been explained to the Probate Court Judges assigned to Jewell Anderson’s Probate cases, the Judges understand what is going on, and have put their feet down relative to allowing Diane Anderson to continue with her physical and emotional abuse of Jewell Anderson.

H.  Probate Court Judges have Rejected Diane Anderson’s Claims of Physical Abuse to Jewell Anderson by David Anderson and Martha Anderson.

Diane Anderson has raised in her elder abuse website, erroneous claims regarding improper medical care, unsuitable accommodations, and other false allegations against David Anderson, Martha Anderson, and Timothy Flynn.  All of these allegations are meritless, and are the result of the creative, but sick, fabrications of Diane Anderson.  Whenever allegations of physical abuse by David Anderson, Martha Anderson, and Timothy Flynn have been raised with the Court, a full hearing has been held regarding these issues, and on each occasion, Diane Anderson’s incredible allegations have been exposed as being untrue.  Shortly after the initial Probate Court intervention was sought in 2004 regarding Jewell Anderson, Diane Anderson retained the outstanding law firm of Morganroth and Morganroth to represent her.  The Morganroth law firm performed an excellent job in presenting the physical abuse allegations at Diane Anderson’s behest, yet despite the outstanding efforts of the Morganroth law firm to convince the Probate Court of these allegations, when the light of truth was shone on these allegations, it became apparent to everyone in the Court system that Diane Anderson’s allegations of improper medical treatment and inappropriate residential accommodations for Jewell Anderson were simply untrue.
