DAVID ANDERSON, MARTHA ANDERSON, AND TIMOTHY FLYNN HAVE NOT ENGAGED IN NEGLECT OF JEWELL ANDERSON:

A.   Lathrup Village Home Determined by the Probate Court as Unsafe for Jewell Anderson to Live at.

Neither David Anderson, Martha Anderson, nor Timothy Flynn have engaged in any neglect relating to Jewell Anderson.  Based upon Jewell Anderson’s dementia/Alzheimer’s issues, along with her unsteady walking problems, the Lathrup Village home has been determined, by the Probate Court Judges, to be an unsafe place for Jewell Anderson to reside.  The Probate Court Judges are concerned Jewell Anderson will fall down the stairs at the Lathrup Village home and cause herself serious injury, if not death.  Based upon the history of Diane Anderson not monitoring Jewell Anderson’s location at all times while at the Lathrup Village home, and which resulted in Jewell Anderson being injured on at least five (5) separate occasions while under the exclusive care, custody, and control of Diane Anderson in 2003 and 2004, it was imperative a safe place be found for Jewell Anderson to live.  The American House facility in Rochester Hills provides a safe environment for Jewell Anderson to live in, provides excellent food for her which is prepared by geriatric dieticians, allows for Jewell Anderson’s medication to be properly administered to her two (2) times a day, and provides a safe environment for Jewell Anderson to enjoy her days, either by herself or with her friends and family.

B.   Best Living Arrangement for Jewell Anderson is the American House Facility.

The living quarters for Jewell Anderson at the American House facility have been reviewed repeatedly by the guardian/conservator for Jewell Anderson and by Court appointed Guardian Ad Litems.  All of these people have determined Jewell Anderson’s living quarters at the American House facility are superb.  Jewell Anderson has expressed her undying gratitude to David Anderson and Martha Anderson for finding her the wonderful facility she has at the American House facility, and for providing the furniture, accessories, and amenities Jewell Anderson enjoys daily while living at this facility.  Again, Diane Anderson’s criticism of the American House facility is totally unwarranted and flies in the face of Jewell Anderson’s statements to all parties concerned that she is content and satisfied at this residence.
